B.C.’s Civil Resolution Tribunal has upheld ICBC’s finding that Gurpreet Singh was 100 per cent at fault for a June 20, 2023 collision at 80 Avenue and 132 Street in Surrey. Tribunal member Amanda Binnie dismissed Singh’s claim after finding he had not shown he bore less responsibility for the crash.

Singh said he entered the intersection on a green light while travelling eastbound and that the other driver, identified as P.K., turned left without looking as the signal changed. P.K. said the light was yellow when the turn began. ICBC considered statements from the drivers and three witnesses, dashcam video and City of Surrey traffic-camera footage.

The camera did not show Singh’s approach or the stop line, but showed the preceding vehicle turning left as the signal changed to yellow and P.K. beginning a turn shortly after the signal turned red. Singh’s vehicle entered the frame while P.K. was turning and appeared to be travelling quickly without slowing or attempting to avoid the collision.

Binnie found Singh clearly did not enter on a green signal and accepted evidence from two independent witnesses that he likely ran a red light. At minimum, she found he entered on a very late yellow and had enough time to stop safely, making him negligent under the Motor Vehicle Act.
